Agreement

By accessing or using kathyking.photography (“the Site”), you agree to these Terms of Service. If you do not agree, please do not use the Site. The Site is operated by Kathy King Photography (“we,” “us,” or “our”), based in Borrego Springs, California.

Use of the Site

You may browse the Site, create an account, purchase products, and subscribe to our newsletter. You agree to use the Site only for lawful purposes and in accordance with these terms.

Intellectual Property

All photographs, text, graphics, and other content on this Site are the property of Kathy King Photography and are protected by U.S. and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our express written permission.

Purchasing a print grants you a personal, non-commercial license to display the physical print. It does not transfer copyright or grant rights to reproduce, scan, or digitally distribute the image.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

Purchases & Payments

All prices are listed in U.S. dollars. Payments are processed securely by Square. By placing an order, you represent that you are authorized to use the payment method provided.

We reserve the right to refuse or cancel any order. If an order is cancelled after payment, you will receive a full refund.

Shipping & Delivery

Fine art prints are made to order. Production and shipping times vary by product. We are not responsible for delays caused by shipping carriers. Risk of loss passes to you upon delivery to the carrier.

Returns & Refunds

Due to the custom nature of fine art prints, all sales are final. If your order arrives damaged, contact us within 7 days of delivery with photos of the damage and we will arrange a replacement or refund at our discretion.

By subscribing to our newsletter, you consent to receive periodic emails about new photography, collections, and updates. You may unsubscribe at any time using the link in each email.

Limitation of Liability

To the fullest extent permitted by law, Kathy King Photography shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of products. Our total liability shall not exceed the amount you paid for the specific product giving rise to the claim.

Disclaimer

The Site and its contents are provided “as is” without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses.

Colors and appearance of prints may vary slightly from what you see on screen due to differences in monitor calibration and print materials.

Governing Law

These terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of San Diego County, California.

Changes

We may update these terms from time to time. Continued use of the Site after changes constitutes acceptance of the new terms.
